Key Clauses in Plant Patent and New Plant Variety Rights Licensing Agreements

Licensing IP rights in relation to living organisms, like any kind of plants irrespective of their botanic taxon, may present some critical and tricky aspects, since, contrary to the “normal” products, they can reproduce themselves after selling. Pros and cons of clauses drafted to address these important aspects will be discussed bringing the point of view of both the IP experts and the breeders.
